The Bond Was Posted.
Why Is My Loved One Still in Jail?
You hear that the bond has been posted, but your loved one is still inside. Posted does not mean released. The bond must reach the proper office, the jail must receive authorization, and staff must complete release processing. A separate case or hold can also keep a person in custody.
There is no statewide release countdown. Sherburne County says processing varies with the time of day and the number of people being released. Other counties have their own procedures.
Ask four questions, in this order
1. Has a release amount or option actually been set? An arrest does not always come with an immediately usable bond amount. All cases must go before a judge first, or a judge must "call in" a bail amount. Ask the jail about the current amount and court file number (if available). An older figure may have changed.
2. Was the bond delivered and accepted? Signing an agreement with a bail agency is a different step from the bail agent submitting the bail to the jail/court. Ask the agent when and where it was delivered and whether the receiving office accepted it. Minnesota district courts require an appearance bond form and a surety power of attorney.
3. Has the jail received authorization to release the person? Once the jail has received the bail bond, jail staff still complete their own checks and paperwork. The agent can confirm what the agency submitted; the jail can speak to its release process. A bail agent cannot promise the hour someone will walk out, as the County Jail determines that.
4. Is there another case or hold? A bond in one court file may leave another warrant, case, or hold unresolved. Sometimes a hold may be requested after bond is posted for a completely unrelated file. Ask the jail whether the person is releasable on all matters. An attorney can help sort out an unfamiliar order.
Keep the person's full name, birth date, jail, file number, bond amount, and agency name together when you call.
Get ready for release
Arrange a ride, charge a phone, and check where the jail releases people. Then read the current signed release order for the next court date and any instructions. Minnesota Rule 6.02 provides different release routes, including money bail without other conditions in some circumstances. Do not assume which route applies based only on the amount paid. A separate no-contact or protective order may have its own restrictions; ask counsel or the court before making housing or contact plans.
Put the hearing date in two calendars. If the paperwork is unclear, confirm it with the court or lawyer rather than relying solely on an online search.
